Force Majeure: This is an unforeseeable circumstance that prevents the Photographer from fulfilling the contract. These acts include fire, casualty, acts of terrorism, civil disturbances, Acts of God like natural calamity which are beyond the control of man. If such acts occur and the Photographer is unable to fulfill the contract agreement, the Client agrees that any amounts of money paid by the Client, less the $50 deposit shall be returned. In the event of the Clients canceling the session for whatever reason the deposit plus $150 cancellation fee is non-refundable. It will be considered as liquidated damages to the Photographer.

Copyright Law: The copyright to all raw and edited images shall remain with the Photographer under South Carolina Law. The Photographer grants the Clients permission to make copies of the images under the following conditions: The images taken by the Photographer are for personal use by the Clients and their friends and relatives. Alteration, Sale, Publication, or any Commercial use of the photographs prohibited without prior written permission from the Photographer.

The client understands that the Photographer may use any images created under this contract for professional samples, displays, internet advertising, exhibitions, contests, and any other purpose. The Client has the option to pay an additional $500.00 NON-USAGE FEE. The NON-USAGE FEE compensates the Photographer for the inability to leverage the photographs as part of her portfolio. This fee is intended to offset the loss of potential marketing opportunities. 

What to expect: Both Client and Photographer agree to arrive ON TIME. An additional $25.00 will be assessed if the client fails to show after 15 minutes past the appointment time. Hair and Make-up services are not provided at this time; however, the Photographer will provide a variety of outfits, props, and backdrops for the photo session at no extra costs. The client may provide additional personal items to the photo session as long as they do not damage any property owned by Chole Allen Photography ( i.e. Whipped cream, mud, honey, sharp objects, or anything that will leave a blemish of any kind).

Creative Process:  Images are edited at the Photographer’s discretion and delivered prints may not include all images shot. The Photographer reserves the creative rights to edit and release only those images deemed creditable as professional quality and within the Photographer’s artistic standards. The Photographer will take several different shots of the Client to ensure the angles, lighting, and background place the Client in the most flattering way. Once the session is complete, the Photographer will choose the best images based on years of experience to edit and process the photos for delivery. This may include a lengthy process of color correction, skin smoothing, highlighting, toning, image sharpening, and some light filters to personalize to the Client. The Photographer will then optimize and format each photo based on its intended use. Photographer will notify the Client when the proofs are available to view in the online gallery. The online gallery will expire ten (10) days after the Client has been notified. Clients may then purchase a variety of formats and sizes of their favorite images directly from the online store. Photo files will not be sent via email. Chole Allen Photography does not sell raw unedited images.

Clear Understanding: The client agrees that no other promises or additional services have been made by Chole Allen Photography and that the Photographer will adhere ONLY to the terms of this contract.
